By using ProjectLance.com, a PortalFeed Media Brand,
you are agreeing the the following Terms Of Service (TOS). ProjectLance may change these
terms at any point without written notice.Signup
Bonus:
(a) Any signup bonuses are contingent on the use
of ProjectLance's services and can not be withdrawn.
(b) Any account that has received a signup bonus
and is under violation of these terms of service can not collect on this signup bonus at
the time of ProjectLance closing the account.
ProjectLance Fees:
(a) Service Providers pay a small
flat $5 commission on all projects won that are NOT featured projects, there is no fee
charged for featured projects won.
(b) Project Managers
1: Regular Projects: Project Manager pays
NOTHING, even when a Service Provider is chosen. There is $0 cost to the Project Manager.
2: Featured Projects: Featured Project cost will be displayed on the project post
form.
(c) Premium Users pay 50% less
commission fees.
ProjectLance rights and obligations:
(a) ProjectLance has the right to refuse service
or membership to any person or persons at it's sole discretion. ProjectLance has the right
to cancel any account without warning at any point for violating the TOS.
(b) Users who are in violation of these TOS will
be immediately terminated from our service. ProjectLance may deactivate any user without
prior notification, however a warning may be issued on certain cases. users that are in
violation of the TOS will not receive any credit or payment from ProjectLance. Users that
are deactivated on any other basis other than violation of the TOS will be entitled to
receive any credit or payment due.
(c) ProjectLance has the right, if we have
sufficient proof provided by another user, our own records or research to claim a user as
fraudulent and ban them from this service.
(d) ProjectLance has the right to remove any
feedback or reviews given to any Service Provider who has NOT paid the past due fees owed
to ProjectLance within a period of 30 days past due or later.
(d) ProjectLance agrees that all information
submitted by users will be kept confidential and not given or sold to 3rd parties, however
ProjectLance and it's parent company reserves the right to use such information within our
own services and or organization. Please see Privacy Policy for
more privacy information.
User Obligations:
(a) Your username and passwords should be kept in
a safe place and you agree that any actions taken in the account management area using
your username and password are final and where actions made by you.
(b) You MUST NOT post your email, website or
contact information on your profile, bids, Message Boards or any place within the
ProjectLance System. You may post a resume and or portfolio of work on your profile page.
(c) You agree to not post any content or files
that are copyrighted or not owned by you, also you agree to not post any software or
scripts fully but just a portion of such software as an example may be permitted, a
section or module being no more than 20% of the work.
(d) You agree not to post logos, pictures or
slogans of other parties and try to act as them, or post work in your portfolio that you
did not do and claim it as your own.
(e) You agree not to advertise any website or
service at ProjectLance and agree to not 'Spam' our service. You also agree to never
attempt to 'Spam' any other user of ProjectLance.
(f) You agree to NOT contact any other user for
any reason outside of ProjectLance.com. You may use the Project Message Boards or the Contact Form Here to send direct messages,
but as outlined above in part (b) you may not submit contact information through these
services, if you wish to converse before a project, please use the services provided by
ProjectLance. Your emails will be provided to the other party when a Service Provider is
chosen and service provider accepts the project.
(g) you agree not to post information mis-leading
another user or making false claims.
Multiple Accounts:
(a) Users may sign up for one (1) Project Manager
account and one (1) Service Provider account. Users may not sign up for more than one (1)
each.
(b) You agree NOT to post projects under your
Project Manager account and then bid on the same project with your Service Provider
account, and or award yourself the bid and give yourself a good review.
(c) No commissions or fees may be earned on either
account to yourself. User agrees that commissions and fees can only be earned by users as
outlined in the Affiliate section.
Communications:
(a) By using the ProjectLance services you agree
to receive email and other communications from ProjectLance that aid in our services to
you. Automated messages may be sent to you that notify you of what is happening at
ProjectLance.com with the services we provide. There are automated notification options in
the members area that you can change if you do not want to receive certain automated
messages, however some automated messages are required to provide this service to you. You
also agree that ProjectLance may send you service change notifications at any time it is
required to do so to inform you about important updates.
(b) You agree to receive a newsletter from
ProjectLance that will not be sent more than once a month. Our newsletters are mainly
geared to keep you interested and informed about the services we provide, and to offer
specials we may have going.
Avoiding fees:
The User is strictly prohibited from trying or
attempting to negotiate a fee for a project with another user or member directly (outside
of ProjectLance) after that project has been created or opened and before the project has
been closed. (after the project closed and before payment is made). This also applies to
any project that was closed without a Service Provider chosen, and then contacting a user
about a project.
Protection:
(a) ProjectLance acts as a 3rd party protecting
you from fraud ONLY if our escrow system is used, we investigate
all claims and make decisions based on the facts given. However, ProjectLance is limited
to only deciding the fate of an escrow account at ProjectLance. If ProjectLance makes a
decision of an escrow account in dispute, You the User are required to agree to the
decision made by ProjectLance and ProjectLance can not be held liable for any reason.
(b) ProjectLance can not be held liable if you opt
to pay a user outside of ProjectLance's escrow system (PayPal and or other means) and you
are frauded or do not get exactly what you paid for. We encourage you to use the escrow
system as both parties have half control over the money until the job is complete and the
buyer is happy.
Bidding On or Posting Projects:
Project Managers:
(a) You agree not to post projects that require a
hourly fee, partnership, trade or any other means other than for a full job complete (for
example a whole script or software written or whole website template made). You may post
such a project ONLY if it is a Featured Project. You also
agree to not post contact information in your project as outlined above in "User
obligations Part (b)".
(b) If you wish to find a person for long term
work or to work on a regular basis you agree to use our Job Board
Posting area where such job posts are accepted.
Service Providers:
(a) You agree to not post hourly rate bids unless
it is on a featured project or you are a certified user.
(b) You agree to not post contact information as
outlined in "User Obligations Part (b)".
Contact:
Both parties emails will be provided to each other
by ProjectLance upon project closing when a Project Manager picks a Service Provider and
Service Provider accepts project.
Liability:
(a) ProjectLance can NOT be held liable for any
dealings you have made with a user of our services. These dealings are out of our control
and we should not be held accountable for your losses due to a fraudulent user. Please Report any fraud as soon as possible. If our escrow system is used
it will cut fraud down and limit a fraudulent users ability to commit fraud. By using our
services you agree that there is a risk and you should take precautions to protect
yourself and you can not hold ProjectLance accountable for the actions of another user.
(b) Since verifying an Internet users identity is
very difficult, ProjectLance DOES NOT VERIFY THE IDENTITY OF USERS OF THIS SERVICE.
ProjectLance serves as a service to connect Project Managers with Service Providers only.
As a result, we can not guarantee the accuracy, quality, safety, legality or truth of the
postings made by users of this site.
(c) Users are aware that by awarding a project to
a Service Provider and Service Provider accepting bid, both parties are entering into a
legally binding contract with each other to fulfill their end of the agreement.
ProjectLance acts as just an avenue for Project Managers to find a Service Provider The
Service Provider is required to complete the project and the Project Manager is required
to pay for it. If a project is cancelled a refund of ProjectLance fees may be in order,
use the Cancellation Form to report a cancelled project. Also
User agrees that ProjectLance can NOT be held responsible for loss or damages after a
project has begun as we are a 3rd party unrelated to the person your dealing with.
(d) Users agree that once ProjectLance has
sufficient proof a user is fraudulent that any payment or funds due to them that
originated from the fraudee may be returned to them and no user can hold ProjectLance
liable for this action. Users are aware that ProjectLance DOES NOT aid in frauding other
users.
Affiliate Program:
(a) The affiliate program is detailed at (http://www.projectlance.com/affiliate.html). If the affiliate
commissions procedures/rates are changed it will only affect commissions earned after the
change has been made. ProjectLance reserves the right to change rates and procedures at
any time without notification.
(b) You may NOT refer yourself nor sign up for
multiple accounts of the same type to collect referral commissions. You may sign up 1
Project Manager account and 1 Service provider account only if you desire to do so. If you
do sign up for both accounts you can not earn a referral commission. You may not partner
with any other user to share or transfer commissions made from your own account. Any
attempts by either party to do these activities will be viewed as a violation of these
Terms Of Service and user or users will be terminated from this service without payment.
(c) ProjectLance reserves the right to delay or
cancel your affiliate commissions and earnings if we find you may have violated the TOS.
An investigation will be made to determine what happened.
(d) ProjectLance reserves the right to delay or
cancel your affiliate commissions and earnings if we feel or find for any reason that the
referred users will not pay the fees charged to them since all your commissions are based
upon those fees.
(e) You agree to NEVER try to act as an official
representative of ProjectLance.com or it's parent company and you agree to only act an an
independent affiliate and never make mis-representations or claims about our service.
(f) You may NOT promote ProjectLance with the use
of Unsolicited Commercial Email or UCE, or any kind of SPAM etc. Any attempt to use
this method to promote ProjectLance will result in immediate termination without
commission payment.
(g) You may create banners or art work of your own
to promote ProjectLance however we require you to request permission and approval to
actually use it in a ad campaign. If your banner is satisfactory it will be approved. Also
you agree that by submitting any banner or art work you produced to promote ProjectLance,
it will become the property of ProjectLance ONLY if it is approved to be used. You MAY be
rewarded with $5-$10 if your banner or art work is of excellent quality and we like it.
Payment of Fees:
You are required to pay all fees due to
ProjectLance within 10 days from the date the fees are due. Any amount still outstanding
after such period will result in the users account being suspended until the payment is
made in full. A notice will be sent to you 5 days after the fees are due to remind you to
make payment, you will have a remaining 5 days to do so.
Withdraw Fees:
(a) Since it cost money to process your withdraw
there will be a fee for all withdrawals. The fees for withdrawals will be listed below.
- $1 per withdrawal for processing PayPal
Payments.
- $2 per withdrawal for processing qualified Check Payments.*
(b) There is a minimum withdrawal amount of $25 +
Withdrawal fee.
* We can only send check withdrawals to United
States users
Deposit Fees:
Since our commissions are at a great low price and
it cost money to transfer money through PayPal and process your regular mail deposits we
have to charge small fees for deposits. This is a charge that is charged to us that we
require you to pay. Listed below are the fees:
PayPal: $2.9% + $0.30 (actual amount PayPal charges)
ProjectLance.com Website & Content:
ProjectLance reserves the right to edit, change or
delete any content within the ProjectLance.com website without any prior notice to you or
anyone. We reserve the right to delete, edit, change or monitor any content you submit to
ProjectLance.com including any projects posted.
Certified Users:
Certified users are users who get special benefits
for displaying their credibility, honesty and verify themselves to ProjectLance and meet
the minimum requirements and pledge to follow our Certified user terms. ProjectLance
reserves the right to deny any user this status.
Offensive Materials:
Users agree NOT to post offensive or abusive
materials or to make any defamatory remarks to other ProjectLance users. Any such post
will be considered hostile activity and will not be tolerated.
